Why the Existing Liability Framework Does Not Fit AI Agents
Product liability law assigns responsibility to manufacturers for defects in their products. In a multi-party AI deployment where a foundation model developer, a platform operator, and an end user are all involved in an AI agent’s decision, establishing which party breached which duty requires analysis that existing legal frameworks are not designed to perform efficiently. The causal chain from model training decision to agent behavior to specific harm is long, multi-party, and technical in ways that current negligence analysis does not handle cleanly.
Contract law covers agreements between specific parties. A user harmed by an AI agent they deployed themselves has no contract with the foundation model developer whose model they used. A third party harmed by an AI agent operated by a business has a potential claim against the business but not necessarily against the model developer whose technology the business used.
How the EU AI Act Changes the Liability Landscape
The EU AI Act, which entered enforcement in 2025, classifies AI systems by risk level and assigns compliance obligations to providers and deployers. High-risk AI systems, which include AI used in consequential decisions about individuals, are subject to transparency requirements, conformity assessments, and human oversight mandates that create auditable documentation of the decision chain.
That documentation changes the liability landscape by creating an evidence trail. An AI agent deployment that complied with EU AI Act documentation requirements produces records of the system’s design, testing, and operation that can be used to establish what the provider and deployer knew about the system’s capabilities and limitations. Deployments that failed to comply with documentation requirements face regulatory penalties that are separate from civil liability for specific harms.
The EU AI Act does not resolve the underlying liability allocation question. It creates a compliance framework that influences how liability arguments are constructed rather than assigning liability directly. Courts in EU member states will apply member state tort law to specific harm claims, informed by whether the AI Act’s requirements were met, but the liability allocation question remains to be settled through litigation.
The Three Parties Whose Exposure Is Increasing Fastest
Foundation model developers are the first party with increasing exposure. As AI agents cause more visible, documented harms, the argument that model developers bear no responsibility for downstream use is facing legal challenge. A model developer who knew that their model had specific failure modes and did not disclose them in documentation may face negligence claims based on that knowledge gap.
Deployers are the second party, and currently the most exposed. A business that deploys an AI agent with tool access and causes harm to a third party is the most natural defendant under current law. The deployer had the operational control, made the deployment decision, and had the contractual relationship with the user. Several 2025 and early 2026 cases in the US and EU have targeted deployers as the primary liable party in AI agent harm claims.
Users who configure agentic systems with capabilities beyond what the deployer provided are the third party with increasing exposure. A user who grants an AI agent permissions that the deployer’s terms of service did not authorize, or who modifies an agent configuration in ways that produce harm, faces liability arguments based on their modification of the deployed system.
What This Means For You
- Document your AI agent’s capabilities, limitations, and failure modes before deployment, both for EU AI Act compliance where applicable and to establish that you exercised reasonable care in understanding what you were deploying.
- Read the terms of service of every model you deploy on. Foundation model developer terms disclaim liability for outputs. Understanding exactly what you agreed to and what liability you assumed when you accepted those terms is essential before an incident occurs.
- Restrict agent permissions to the minimum required for the task. Permission scope determines damage radius, and damage radius influences liability exposure. An agent with narrow permissions that causes harm has a smaller harm footprint than an agent with broad permissions that causes the same underlying mistake.
